General Terms and Conditions of Sale (GTC)
1 - Acceptance and Application of Terms:
The customer acknowledges having read, at the time of placing an order, the sales conditions stated here and declares to accept them without reservation. These general terms and conditions of sale govern the contractual relationships between the company Aqualumi and its customer, and both parties accept them without reservation. These general terms and conditions of sale will prevail over any other conditions appearing in any other document, except for prior, express, and written derogation. The seller is defined below as the company Aqualumi and its website, aqualumi.fr, and its sub-site aqualumi-lanterns.com represented by Mr. Arsène Khan, whose registered office is located at 26 rue Paul Bert 92800, Puteaux.
The company is registered with the Trade and Companies Register of Nanterre under Siret number 52317799600023, and the buyer is defined below as the company or person signing and accepting these sales conditions. The buyer acknowledges having the legal capacity to contract under the conditions described below, meaning having reached the legal age and not being under guardianship or curatorship. The buyer acknowledges having read these general terms and conditions of sale before placing an order.
2 - Prices
Aqualumi reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time of order registration (subject to availability). Products remain the property of Aqualumi until full payment of the price. Our product prices are indicated in Euros. The prices indicated on the product pages are inclusive of all taxes and include VAT for France and CEE countries but do not include extra taxes for countries outside the EEC. When ordering via the internet, the total price indicated in the order confirmation includes the price of the products, as well as shipping fees.

The automatic recording systems communicated via the internet and the order forms sent by the customer by mail are considered as proof of the nature, content, and date of the order. When ordering online, Aqualumi confirms the acceptance of the said order to the customer at the email address provided.
4 - Availability
In case of temporary unavailability, Aqualumi reserves an additional one-week period for processing the order. In case of permanent unavailability of a product after the order has been placed, the buyer will be notified by email or phone about the out-of-stock items. The buyer will then have one working week to request the cancellation of the order by contacting our customer service. After this period, and if no request is made, the order will be shipped with the available items, and only these items will be billed.
5 - Delivery
Products will be sent to the delivery address that the buyer has indicated during the order process. In case of errors in the recipient's address, the seller cannot be held responsible for the inability to deliver the product. Participation in shipping costs is inclusive of all taxes. Any delays do not entitle the buyer to claim damages. In case of visible defects, the buyer has the right to return the product under the conditions provided in this document.
If, despite the care we take in packaging our products, you find that your products are damaged upon receipt, please send us a description of the damage along with photos within 48 hours of receiving your package. Please note that we cannot accept claims after this period.
Following the receipt of your claim, we will offer either a partial or full refund or the shipment of a partial or full replacement order.
6 - Payment
Payment for purchases is made in euros by Visa, Stripe, PayPal, or bank transfer.
7 - Secure Payment
The customer's order will be considered effective only when the relevant bank payment centers have given their approval. In case of refusal by these centers, the order will be automatically canceled, and the customer will be notified by email.
8 - Right of Withdrawal: Satisfaction Guaranteed or Your Money Back
Any return must be the subject of a return request from the contact page. The buyer has a period of 14 days from the date of delivery of the order (in accordance with Article L121.20 of the Consumer Code) to return any product that is unsatisfactory, in its original packaging, undamaged, and unopened.
Aqualumi will then refund the returned product(s). Return shipping costs are the responsibility of the customer. In the case of an exchange, if the customer wishes to place a new order, the shipping costs will be borne by the customer. However, we cannot accept the return of items that are incomplete, damaged, opened, or soiled by the customer, or items not returned intact in their original packaging. Return costs will be borne by the sender. The return of products will result in a refund equal to the purchase price of the product(s) purchased. The refund includes the initial delivery costs. Upon processing your return, we will send you an email or call you to inform you of the amount of your refund. The refund will be made within a maximum of 14 days from the date of withdrawal (as confirmed in the email sent to the customer) in accordance with Article L121-20-1 of the Consumer Code.
9 - Applicable Law and Disputes
Complaints or disputes will always be received with attentive benevolence, with good faith always being presumed in those who take the trouble to present their situations. In the event of a dispute, the customer will first contact the company to seek an amicable solution. This contract is subject to French law. The language of this contract is French. In case of a dispute, the Nanterre court is solely competent. Aqualumi cannot be held liable for damages of any kind, whether material, immaterial, or bodily, that may result from the improper functioning or misuse of the products sold. Aqualumi's liability will, in any case, be limited to the amount of the order and cannot be invoked for simple errors or omissions that may have persisted despite all precautions taken in the presentation of the products. In all cases, Aqualumi cannot be held liable for non-compliance with the regulatory and legislative provisions in force in the recipient country. Its liability is systematically limited to the value of the product in question, as of its sale date, without any possibility of recourse against the brand or the producing company of the product.

10 - Personal Information
Aqualumi undertakes not to disclose to third parties the information provided by buyers and visitors to the site. This information is confidential. It will only be used by its internal services for order processing and to enhance and personalize communication, particularly through information letters/emails, as well as for customizing the site based on user preferences. This article cannot prevent the assignment or transfer of activities to a third party. In accordance with the Data Protection Act of January 6, 1978, the buyer has the right to access, rectify, and oppose personal data concerning him/her. To exercise this right, simply send an email or a letter indicating the email address, name, first name, and address.
